Since he's HIV-positive it can fairly easily be proven beyond a reasonable doubt that he had malicious intent to spread the infection.

It is an interesting situation though. Because, as far as I know, most experts still maintain that HIV cannot be passed via saliva, right?
If it can't -- then arguing that his saliva was a "deadly weapon" is a bit of a stretch, isn't it?
Plus, intent might be an issue. This guy was drunk -- I think he spit on the cop because he was an idiot -- not because he thought about the HIV. Maybe not though -- hard to say. But I'm not sure he ever had the conscious thought that he was going to try to put some HIV into someone else. I'm not sure the intent was there. Crazy stuff though.

I was gonna make a " well, at least they didn't give him the death sentence" joke but there are just to many laws that protect the police. the second amendment is in place for a reason; so no one gets too arrogant, yet we have forgotten that aspect. The cop should have to prove, beyond reasonable doubt, that the man intended to cause him harm (because from what i read he was just drunk) but also that he himself is now HIV+ due to this exchange. it's also funny/sad to think that this man gets access to some decent medical care (free prison medical care) whilst the officer, if indeed infected, may not. |

If the cop now had HIV, then they would have charged him with something closer to murder instead of just use of a deadly weapon.
And, the officer isn't infected. I guarantee it. There isn't any cases of someone getting infected via saliva -- I doubt that this will be the first one.
That is why I was saying before that it is a bit odd to call the guy's spit a "deadly weapon" since, as far as we know, HIV simply cannot be transmitted via saliva by spitting on someone.
Maybe if there was blood in the HIV guy's mouth and a huge open sore in the cop's mount -- then MAYBE. But, even that being said, we have no cases of this ever happening.
