ok so my lil bro's 360 got banned from xbox live..does anyone know how to fix that? also how did he get banned he has firware 1.5 and from what i heard 1.6 only makes it easier to back up ur games could he have got banned for not being upto date on that.... any info would be cool thanx |

As far as I know just getting a new gamertag lets you back in. Does it track you by IP address?

Weird. I know when kids would mod accounts on Halo they could just change their gamertag and get back in. They used to stock up on 1 month cards just to fudge around with modding. I guess they might have been doing something else to get back in though.

No it was my legit gamertag. I was 120 from 50,000 points and they banned me and on top I had probably almost a thousand bucks in dl content on it. |

I heard, although I don't know how true it is, that if you have ever played a back up game (stealth or not) while connected to LIVE, that MS will ban you eventually. Even if they haven't got around to you yet, they have a log of every modded console that has every accessed LIVE. Perhaps there is some truth to this. If you play back up games you already own, you should have a separate modded console dedicated for such games... and never connect to LIVE. |

Nobody knows for sure what they can detect. Playing on Live is a risk in itself with such games, but what they can and can not detect isn't certain

Having a modded console isn't the same as pirating. Modding your console is perfectly legal, but is against MS LIVE policy. A lot of people use modded consoles to play back up games of which they own the original... which is legal. So I do not understand how you can assume someone is a "cheater" before knowing the whole situation. |

Dude are you high? Backups are pirated copies of games. Notice the disc is just blank and when you put it in BAM theres the game! That is 100% illegal so yes thats why they get banned.

It's 100% legal to make backups of games you own so long as you are making the backup yourself (as opposed to downloading it) and you own, and keep, an official copy. GET IT TOGETHER, MAN. |

Im talking about the consoles that are modded to play backup games. Stick in a disc and you have 3 new games downloaded. Xbox.com had a big thing on it. Its illegal (maybe not the law of the land) but in MS's eyes its illegal and they will ban you. Thats just a fact dude.

Because when people talk about backups they are, for the most part, talking about the modded ones. Not just a backup of a game or two you made just in case. MS comes down HARD on that. I actually didnt even think of the kind you were talkn about.

I thought many countries/states in America had it, so that a company couldn't just create a policy and then claim everyone must abide by that? In New Zealand, Sony gives you a 1 year warranty, and have it in the liability/terms of use that its not their problem after a year. But if you take your dead system to the courts, they'll count it as a computer and you therefore get a 7 year warranty. Genius!
I'm surprised then that Microsoft are allowed then to do this for a modified console and get away with it with just having a terms of use that isn't overthrown by some other law. Because its perfectly legal to mod your 360 to play backups. It is simply those backups with are obtained illegally are... well, illegal. I'm surprised Microsoft can just go and brick your console from connecting online and stop you from accessing purchases that you paid for for doing something completely legal.
