Hello all,
I need some advice, I have a problem that I have never ran into before, I have a pending trade with someone on gametz and we have both sent, The game I sent was factory sealed never opened I know this for sure I bought it from retail Myself.
The other trader received today and says that they opened the game and there were no disc inside, I have no way of knowing if that's true or not. The other trader has great feedback but also has less then half the trades I have. I'm just confused as what to do. any help.

Its very possible that it was a demo version of the game and the store forgot to put the game back in the case.
as for how to resolve this? i have no idea, ask bill. He will probably just suggesting some sort of compromise, like splitting the loss. These are about 10 to 12 dollar games? maybe send him 5 or 6 dollars paypal?

Well Alabama fan, I just had a look at your pending trade, and the other trader's page.
This is a crummy situation, but I believe the other trader is probably telling the truth. If you have the receipt for the game you sent (unlikely), you could have him send back, you go back and exchange for another copy, and hope it works out this time.
The alternative, unfortunately, is for you each to keep what you get. Its not your fault that a sealed game didn't have the disc inside. That probably won't go over real well with the other trader, but its the way it is.
Not much help, I know, but its all I can come up with. |

Hard situation! Did he say it had a manual in the case? Did it arrive to him still sealed? Was the wrapper cellophane with folded corners or shrink wrap?
You might ask him to check the wrapper for signs of tampering and if it looks like it was messed with before you bought it, try to ask the store for a replacement.
Other than that, there is no good answer. If I were in your place, I would ask him to split the cost of buying a used replacement for the missing game or, if he didn't feel ok with that, pay for a used replacement by myself. If he is being dishonest, at least you will have a clean conscience and he'll be the loser in the end. |

I bought Tomb Raider Anniversary (ps2) for my last anniversary with the girlfriend, and when I gave it to her it was indeed sealed. She opened it right in front of me and there was no disc inside. I guess this sort of thing just happens sometimes. Probably a packaging error?
What is the game in question? Maybe it's something by the same company, or some other similarity?

Extremely odd! Maybe it would be worth a call to the game's manufacturer. If it is some kind of packaging flaw, maybe other people have had it happen too and the company might offer a replacement. |

These games are packed by machines though so its hard to assume human error. There really is no way to tell since you are just going by his word. If you still have the receipt id ask to get it shipped back to you and tell the store. You shouldnt be punished since you bought the game brand new. Very odd though... you didnt notice the case was a little lighter then it should be? Im not much of a gamer but i can tell when something is missing from a case just by holding it. Anyone else feel the same way? |

I don't see any indication that the other trader is lying about what happened. So, I think the right thing to do is assume he's telling the truth. Then, try to work something out that's fair. If you have the receipt still, returning it seems like a decent option. Another thing to try might be to call the maker of the game and tell them you got a box without a disc. They'll probably tell you to return it, but if you don't have a receipt, maybe they would help you out (long shot, but worth a shot, perhaps... I have heard of stories in the past where discs were provided by the maker).
Otherwise, "share the loss" is usually the fairest thing we can think of. It's neither trader's fault, so split the loss in some way. |

I don't have a receipt since it was bought a few months back, so returning it to the store is out as an option,
So is it fair to send a $5 money order that's half the price for a used copy of Tomb raider plus $1.27 for shipping for a total of $6.27. and of course He can still call the maker of the game and see if they will help.

I know it may not help with your trade right now but you should contact the software company as this is a packaging error. The same thing happened to me recently. I bought a new sealed game from a retail game shop, got home, opened it and no disc inside. I took it back to the shop with receipt and they claimed that would never happen and accused me of lying. I then sent a letter to Konami complaining about the product and told them what happened at the store. A few days later I got a phone call from some manager at Konami appologizing and said he would send a replacement. 2 days later a package arrives with replacement game, 6 other latest release titles, and lots of demo products. A few days after that a letter arrives from the game shop that sold it appologizing for my treatment and included a 10000yen (about $100) voucher for the store! Obviously Konami contacted them. All this without ever showing a receipt to Konami. Man I love Japan!
